Welcome to Pak-Mahi Dost (PMD-PAK), the comprehensive digital traceability system for marine fisheries management operated by the Marine Fisheries Department, Government of Pakistan. By accessing and using this system, you agree to be bound by these Terms and Conditions.

Please read these terms carefully before using our services. If you do not agree with any part of these terms, you must not use the system.

1. Acceptance of Terms

By registering for an account, accessing, or using the Pak-Mahi Dost system, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy. These terms constitute a legally binding agreement between you and the Marine Fisheries Department.

2. Description of Service

Pak-Mahi Dost is a digital platform designed to provide comprehensive traceability and management services for Pakistan's marine fisheries sector. The system includes but is not limited to:

  • Trip management and tracking
  • Fishing activity recording and monitoring
  • Fish lot management and traceability
  • Boat and vessel registration
  • Export documentation and compliance
  • Supply chain transparency
  • Regulatory reporting and compliance

3. User Registration and Accounts

3.1 Account Creation

  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account
  • You are responsible for all activities that occur under your account

3.2 Account Types

The system supports various user roles including:

  • Boat Owners and Captains
  • Middlemen and Distributors
  • Exporters and Processors
  • Government Officials and Administrators
  • Public Users (for traceability search)

4. User Obligations

As a user of the system, you agree to:

  • Comply with all applicable laws, regulations, and fisheries policies
  • Provide accurate and truthful information in all submissions
  • Maintain the security and confidentiality of your account
  • Use the system only for lawful and authorized purposes
  • Not attempt to gain unauthorized access to the system or other users' accounts
  • Not interfere with or disrupt the system's operation or security
  • Not use the system to transmit malicious code, viruses, or harmful content
  • Respect intellectual property rights and not infringe upon them

5. Data Accuracy and Responsibility

You are solely responsible for the accuracy, completeness, and legality of all data you submit to the system. You acknowledge that:

  • False or misleading information may result in account suspension or legal action
  • You must maintain proper records to support all data entries
  • Government authorities may verify and audit submitted information
  • Inaccurate data may affect traceability and compliance status

6. Compliance with Regulations

Users must comply with all applicable fisheries laws, regulations, and government policies, including but not limited to:

  • Marine Fisheries Ordinance and related regulations
  • Export control and documentation requirements
  • Environmental protection and sustainability standards
  • Food safety and quality assurance requirements
  • Customs and trade regulations

7. Intellectual Property Rights

All content, features, and functionality of the Pak-Mahi Dost system, including but not limited to text, graphics, logos, icons, images, software, and design elements, are the property of the Marine Fisheries Department, Government of Pakistan, and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or commercially exploit any part of the system without prior written authorization.

8. System Availability and Modifications

We strive to ensure the system is available and functioning properly. However, we do not guarantee:

  • Uninterrupted or error-free operation
  • Immediate resolution of technical issues
  • Compatibility with all devices or browsers

We reserve the right to modify, suspend, or discontinue any part of the system at any time with or without notice. We may perform scheduled maintenance that may temporarily affect system availability.

9. Limitation of Liability

To the maximum extent permitted by law, the Marine Fisheries Department shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the system.

10. Indemnification

You agree to indemnify, defend, and hold harmless the Marine Fisheries Department, its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the system
  • Your violation of these Terms and Conditions
  • Your violation of any law or regulation
  • Your infringement of any third-party rights

11. Account Suspension and Termination

We reserve the right to suspend or terminate your account at any time, with or without cause or notice, for any reason including but not limited to:

  • Violation of these Terms and Conditions
  • Fraudulent or illegal activity
  • Provision of false or misleading information
  • Non-compliance with fisheries regulations
  • Extended period of account inactivity

12. Privacy and Data Protection

Your use of the system is also governed by our Privacy Policy. By using the system, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

13. Dispute Resolution

Any disputes arising from or relating to these Terms and Conditions or your use of the system shall be resolved through:

  1. Initial consultation with the Marine Fisheries Department
  2. Mediation through appropriate government channels
  3. Legal proceedings in accordance with Pakistani law

14. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify users of significant changes through the system or via email. Your continued use of the system after such modifications constitutes acceptance of the updated terms.

15. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Pakistan. Any legal actions or proceedings shall be subject to the exclusive jurisdiction of the courts of Pakistan.
